Distance Agreement

This Agreement is between the owner of the sales website www.megango.com, ORCCAN SIA (Registration No. 40103949850; legal address: Tālivalža iela 20 k-1 – 14, Riga), hereinafter referred to as "(the) Seller", and the Buyer who places an order and makes a purchase on the sales website www.megango.com. The Distance Agreement applies to all orders and purchases made on the sales website www.megango.com.

1. With this Agreement, www.megango.com shall undertake to deliver the Goods ordered by the Buyer on the sales website www.megango.com, and the Buyer shall undertake to accept and pay for the ordered Goods, depending on the type of delivery selected.
   2. The Buyer shall order the Goods by filling out the relevant order form on the Seller's website, www.megango.com. When placing the order, the Buyer shall undertake to provide accurate information – i.e. name, surname, delivery address and his/her other contact information – and shall make the purchase by clicking on the field “Make purchase”. The Buyer shall be responsible for the correct presentation of data – otherwise, the delivery of the Goods will not be guaranteed. The ordering of the Goods shall be regarded as the Buyer's offer to the Seller to enter into this Distance Agreement for the delivery of the ordered Goods, and it shall be regarded as the Buyer's consent to purchase the ordered Goods at the specified price. If the order is correctly placed, a pop-up text containing your order number will appear.
2. After placing the order, the Buyer will receive an automatic e-mail with the order confirmation. Once the Buyer has received the automatic order confirmation from the website www.megango.com, www.megango.com shall be regarded as having accepted the Buyer's offer for the Distance Agreement, and this Distance Agreement shall be regarded as concluded between the Buyer and www.megango.com.
   4. The prices of the Goods indicated on the website www.megango.com include value-added tax. The offered prices are valid for the specified period, if any such period is indicated. The cost of delivery services for the Goods will not be included in the indicated price of the Goods, but they will be visible at the time of the placing of the order.
   5. The Buyer may exercise the right of withdrawal and return the Goods within 14 (fourteen) calendar days. In order to avoid disputes, upon receipt of the Goods, the Buyer must ensure that they correspond to what was ordered (the title of the Goods, their colour, and other relevant parameters).
3. In the event that the Goods have been assembled inaccurately, the Buyer shall be entitled to exchange the Goods within 14 (fourteen) days by filling out the return form. In the above type of case, the return costs shall be borne by the Seller.
4. If the Buyer wishes to exercise the right of withdrawal, the following recommendations and conditions must be taken into account:

7.1 The Goods that are being returned must not be used (in view of the specific features of the Goods). If the condition of the Goods being returned has deteriorated, and this has happened due to improper storage, the Buyer shall not be entitled to exercise the right of withdrawal.

7.2 The Buyer shall be obliged to keep the original packaging of the Goods, and not damage it.

7.3 If the Buyer wishes to exercise the right of withdrawal, then he/she must contact the Seller at [email protected], and must fill out the Right of Withdrawal form.

7.4 The Seller shall returns the money for the returned Goods, and the delivery costs for the Goods, to the Buyer via the bank account specified in the withdrawal form, within 14 (fourteen) calendar days after the termination of the Agreement, and after the Goods specified in the withdrawal form have been received at the Seller's warehouse (Rēzeknes iela 3a, Riga, Latvia, LV-1073) on the basis of the Buyer's withdrawal.

8. The following deadlines are hereby set for the fulfilment of the order:

8.1 In Europe: within 1 to 14 working days from the time of the order confirmation, if the Goods are in stock.
8.2 For Goods that are not in stock, the order fulfilment period shall be 1 – 30 days.

9. In the event that the Goods ordered by the Buyer are out of stock at the manufacturer's warehouse, the Buyer shall be immediately notified, in writing, at the e-mail address that the Buyer has provided. In such a case, all payments made by the Buyer shall be refunded to him/her; or, if the Buyer so chooses, equivalent Goods shall be offered at an equivalent price.
10.  The Buyer shall pay for the Goods in the online shop www.megango.com using a payment card or PayPal. All delivery costs shall be borne by the Buyer.
11. The Buyer hereby confirms that he/she has read the terms of this Agreement, and shall undertake to observe and comply with them.
12. The Buyer is hereby informed that the Seller is entitled to unilaterally change the terms of this Agreement at any time.
